These Terms of Service (“Terms”) govern your access to and use of our websites, mobile sites, emails, social media, and any other online services that link to these Terms (collectively, the “Service”), including purchases, subscriptions, and communications with NOLEY. By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

• We may modify, suspend, or discontinue the Service at any time without notice.

Automatic Renewal & Subscription Policy

• You may purchase automatically renewing product subscriptions (“Subscription”). Your chosen frequency, quantity, and product(s) are shown at checkout and in your account.
• By starting a Subscription, you authorize us to charge your payment method at the stated interval until you cancel. Taxes apply. Prices may change; we will notify you of material changes before the next renewal.
• Cutoff to ship/cancel: Cancel at any time before the next charge posts. Already-processed orders follow our policies.
• Manage or cancel in your account or by emailing hello@noley.com.

Products, Pricing & Purchases

• We may change products, specifications, and pricing without notice. Displayed colors may vary by device.
• Orders are offers to buy. We may accept, reject, or limit any order (including quantity limits and anti-resale restrictions).
• Billing information must be current and accurate. We may place a temporary authorization hold to verify funds.

User Contributions

Arbitration; Governing Law; Venue

Arbitration Agreement. Any dispute or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The seat of arbitration shall be Wyoming, and the language shall be English. You and NOLEY waive the right to a jury trial.

Class Action Waiver. To the fullest extent permitted by law, disputes shall be conducted only on an individual basis and not in a class, consolidated, or representative action.

Opt-Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@noley.com with subject line “Arbitration Opt-Out” and your name and the email used for your account.

Governing Law; Court Venue. These Terms are governed by the laws of the State of Wyoming, without regard to conflicts of law principles. If arbitration is found unenforceable for a particular claim, exclusive jurisdiction and venue shall be the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction there.

Electronic Communications; Notices

By using the Service, you consent to receive communications from us electronically (e.g., email, notices on the Service). You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirements that such communications be in writing.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Service (and, if you have an account, we may also notify you by email). Changes take effect upon posting unless otherwise stated. Your continued use of the Service after changes become effective constitutes acceptance.

Miscellaneous

• No waiver of any term shall be deemed a further or continuing waiver of such term.
• If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
